Why learn about Virginia DUI law from lawyers with such backgrounds?
Because these are important cases!
Nothing is more stressful than being charged with a DUI in Virginia. The stakes are high and the cases move very fast. People who are in positions of trust -- such as police, prosecutors, and other law enforcement officials -- are suddenly "on the other side."
Virginia DUI law is surprisingly complicated. The law occupies over 40 pages of the Virginia Code. Conversely, the law outlawing murder is a mere sentence! The state's high courts regularly consider novel DUI defenses. In 2005 alone, for example, Virginia's state and federal courts issued over 14 written opinions explaining and interpreting Virginia DUI laws. This law changes every year but, just recently, in 2009, the breath test device was changed for the first time in over a decade.
The law constantly changes because Virginia DUI cases are some of the most complex criminal cases to prosecute and defend. They involve constitutional issues, statutory construction issues, scientific issues, and factual issues.
This site is designed to give you an overview of DUI law. Do not rely on it for legal advice. Every case is different depending on the facts. Be sure to consult a lawyer for your specific case.
This page will not tell you how to “get off” of a DUI in the future. There is only one, 100% way to avoid a DUI conviction -- don’t drink and drive. This means, do not even have one beer before getting behind the wheel of an automobile. The laws in Virginia are extremely strict; and a conviction will result in very harsh punishment. It is just not worth it.
Our firm’s Virginia DUI section has experienced lawyers who aggressively defend these serious cases.
